The Madras High Court on Wednesday stayed the screening of the movie “Main Hoon Rajinikanth,†named after superstar Rajnikanth, after the actor sought relief, saying the film might defame him and hurt his fan base.
Rajnikanth invoked the concept of “personality right†and sought protection against its infringement. In his petition, the actor explained how without seeking his written or oral consent, using his name can mislead the huge fan base the star has today.
Justice S Tamilvanan granted interim injunction and restrained Varsha Productions of Mumbai, from releasing the film using the superstar’s name.
Rajnikanth contended that he did not endorse any product or film or write-up using his name or personality, as it might end up misleading his large number of fans.
“Rajnikanth’s irrefutable acting ability, charisma, distinct personal style, mannerisms and stylised delivery of dialogue in films have contributed to his mass popularity and appeal.
His popularity comes from his larger-than-life appearance in many films, supported by gravity-defying stunts and charismatic expressions/dialogues which often attain cult status, whilst preferring to maintain humility and simplicity in real life,†the actor’s application said.
The petition further said that a large section of the public across India is, therefore, likely to be misled into viewing such project/film on the mere belief that the said project/film had been approved by their matinee idol.
As for the film in question, Rajnikanth said various press releases, video releases, web articles, posters and information from other sources about the feature film “Main Hoon Rajinikanth†revealed that the producer had lifted/exploited the super hero image of Rajinikanth from various movies by including in the forthcoming feature film, which also has scenes of immoral nature.
