In a landmark judgement the Supreme Court has stated what effectively discards the Muslim personal Sharia Law in terms of marriage. The court has said that Muslim men can’t have more than one wife, as per the law of the country. Article 25 of the Constitution allows any individual right to practice and propagate any religion of their choice and observe its core practices.
But when it comes to polygamy the court says “..what was protected under Article 25 was the religious faith and NOT a practice which may run counter to public order, health or morality.” Also monogamy was a reform within the power of the State under Article 25.
Hope the nation moves towards full fledged Uniform Civil Code like the ruling party had promised before General Elections.
