Private hospitals in state can’t deny treatment

Instances of private hospitals denying treatment to dengue patients in Delhi have shocked the nation. With rising viral infections being a major issue in Bengaluru and other parts of Karnataka, many are worried about the plight of patients here.
Dr HN Usha, senior paediatrician with St Martha’s Hospital, said: “We are not completely autonomous; the state government has some control. We can never refuse admission to any patient. In case we don’t have a particular facility, we immediately refer the patients concerned to other hospitals.”
The health department, however, claims there is no need to worry.

The state government says it has a stringent law in hand, which helps them exercise control over private hospitals in case of emergencies.

“The situation in Karnataka and Delhi is not similar. Under the Karnataka Private Medical Establishment Act, implemented in 2007, we can take action against any erring private health facility. The Supreme Court has also made it clear that no private hospital can reject treatment to patients. They have to stabilize critical patients first and if necessary, do an organized referral later,” said Dr Rajani M, district health officer.
